Home Games (not TD related)
« on: October 01, 2010, 12:06:36 PM »
Not sure how you all go on in the USA, I have to go through all this now.
Bear in mind the most that I can have playing at my place is 18.

Me and Mrs mac are banned from the G casino, long storey but there it is.
As part of there procedure they complained about the Garage to the gambling commission.
I have no problem with this as I have said before.

So today I had a visit.

Actually not from the gambling commission but some guy from the council and a police officer with a knowledge of the gambling law.
They are to report back to the gambling commission.

First thing they said they just want to see what it was all about, no problem.

Showed them the Garage, it was set up for my 10 seater tomorrow.
The first thing they was interested in was the fruit machine (play money), I told them it was only for fun, they accepted this but
stated it's only a matter of pressing a button and it's real money (they are correct).
So we discussed several ways for me to run it on real money legally, they said licence the house as a pub and pay the
fee and you have no problem with the poker either, wrong the poker would then have a weekly limit.
I told them the machine only takes room up so it will be on eBay next week.

I was then asked about the rake I take (knew this might be a problem), I said this is to cover my expense of tea, coffee, supper and other
stuff.
They said it is illegal to charge this, I told them no problem I will stop charging it but I know the players are still going to pay it.
To that he shrugged his shoulders.
The biggest problem was how it was all laid out on my web site, (it states the rake on here).
No problem I will change the web site to suit no rake.
I was then asked how much we play for, I said that was irrelevant we could play for any stake we wanted but I told him.

One of them said it's got a bit bigger than a home game here, I said no it's a home game once a week with friends and acquaintances.
They said they had not come to charge me with any offences but I must bear in mind that a few people in the London area have
had some big fines for doing what I am doing.
I have not heard of any home games being busted.

Any at the end I said OK I will lose the fruit machine, change the web site and stop the rake, will that be OK.
They did not really answer all they said was they would report back to the gambling commission.

So my game tomorrow is still on.

I will implement the three changes then see what happens next.

hi maccaman,

I have detailed familiarity with the GC guidelines - but they are only that, local authorities are free to interpret the legislation in any way they wish, and this varies widely.

If you want to give me a phone I can talk you through the compliance issues you are facing.

Stuart

Playing poker for money is technically illegal here in wisconsin, as are having over a set amount ofthemachines you had described. While I run a league where there is no buy in, I know that in my area (Northeast Wisconsin), groups that do play for money typically get around this by being a club where they have to pay dues to be in it. In turn, they "distribute" the dues to the top X players at the end of the tournament. From What I have heard, this one group does this on a monthly basis, but rotates between 4 bars so that they are able to do it weekly.

Here in Arizona it’s on the books in Arizona as Social gambling. It’s totally legal provided that the house does not profit in any way from the outcome of the event. All money exchanged by those seated at the table. We also have free poker in Arizona in bars and restaurants. The bar or restaurants pays an outside company to host a tournament. In return the bar/restaurant makes money on drink or food sales. Usually the winner of these events can earn money or gain a seat in a much bigger event.

This is the UK Gambling Commission guidance for staging a game of poker in a private locale, it's rather bland, but the main things are - don't charge a participation fee and avoid public invitations to the game.

Stu

Can I play poker at home?

Playing games of poker in your own home, between friends and on a non-commercial basis is legal. However, the rest of the participants must be your legitimate guests or friends, you cannot invite members of the public to join in, and you cannot ask people to pay a fee separate from the stake to take part.

There is no limit on the stakes and prizes you can play poker with at home.

You can play poker in student halls of residence, as long as the other players are exclusively or mainly students resident in that establishment and you do not charge for participating or take any money from the stakes or prizes.

You can also play poker at your local village or church hall as long as you comply with the conditions for private gaming, that is that there is no charge for participation (excluding stakes) and the public do not have access to the venue.

You can also run a poker night for charity.
